General Sales Conditions (GSC)

The purpose of these general sales conditions is to define the obligations of the parties and the conditions of sale of products sold on the website https://www.uman-krapul.com/

Any purchase on this site implies, on the part of the customer, unconditional acceptance of these general sales conditions.

If any provision of these GSC is cancelled, in whole or in part, the validity of the remaining provisions shall not be affected. In this case, the parties shall, if possible, replace the cancelled provision with a valid provision corresponding to the spirit and object of the contract.

The fact that one or the other party does not claim the application of any clause of these GSC or acquiesces to its non-performance, whether permanent or temporary, shall not be construed as a waiver by that party of the benefit of said clause.

 

Products sold

All information and characteristics of products sold on the website, as well as photographs, illustrations, etc., are provided for information purposes only.

Unless otherwise specified on the website, all products sold are new and comply with the legislation of the European Community in force and with applicable standards in France.

It is expressly agreed by the parties that the products sold are not returnable and may only be exchanged in case of a mistake in size, etc., on the part of the customer at the time of purchase.

The available products are those displayed as such on the website on the day of the order and within the limits of available stocks. The seller undertakes to honor orders only within the limits of available stocks. In case of immediate unavailability, the seller undertakes to contact the customer as soon as possible to inform him/her of a new availability deadline.

The seller may withdraw any product displayed on the website at any time.

 

Ordering process

When ordering, the customer undertakes to provide accurate and complete information.

In order to be able to order on this site, the customer must create a customer account. Each customer can only open one customer account.

Following registration, the customer will be prompted to choose a secure password when creating his/her account, which will be confidential and should not be disclosed to third parties.

Under no circumstances can the seller be held responsible for any loss, theft, or fraudulent use of the customer's account.

The customer is invited to follow and respect the current order process on the website at the time of their order.

The date of the order is considered to be the date of confirmation of the order by the seller, which is sent by email to the customer after the order has been effectively paid, provided that the email address given in the registration form is correct.

Before confirming and paying for their order, the customer will see a summary page showing the selected products, their references, quantities, unit prices, and total prices. The customer agrees to verify the accuracy of their selection before confirming and paying for their order.

Prices:

The prices charged are those in effect on the website on the day of the order. They are denominated in € and include VAT. The applicable VAT rate is the one in effect on the day of the order.

The prices may also include any applicable delivery charges on the day of the order. The prices indicated include, if necessary, any discounts that the seller would have to grant to the customer.

The seller reserves the right to modify its prices and financial conditions at any time. However, the seller commits to invoicing the ordered products under the conditions and at the prices indicated at the time the order is registered.

Invoices and Payment Terms:

The invoices are sent to the customer electronically or during the delivery.

The price of the order is payable in full on the day the order is placed by the customer. Any payment will be considered final only after the seller has effectively and completely collected the sums.

The accepted means of payment to settle the orders are bank card, Paypal, and Stripe.

The seller does not bear the costs related to payments from countries other than France.

The seller will not be obliged to deliver the ordered products if the price has not been fully paid beforehand.

 

 

Reservation of ownership

The seller retains full and complete ownership of the products sold until full payment of the principal and accessories.

The above provisions do not prevent the transfer of risk of loss, theft, or damage to the products subject to the reservation of ownership to the customer upon delivery, as well as any damages they may cause.

 

Delivery - Transport – Reception Delivery

Delivery is made by La Poste, Colissimo, or Mondial Relay.

Deliveries are made worldwide.

The delivery times specified at the time of ordering are indicative. Therefore, any reasonable delivery delay shall not entitle the customer to damages or cancellation of their order.

In case of force majeure, the seller is released from their obligation to deliver.

In addition to the situations considered as "force majeure" by case law, the following are also considered as cases of force majeure: total or partial strikes, floods, epidemics, fires, etc.

 

Transport

The seller is deemed to have fulfilled their contractual obligation as soon as the package is handed over to the carrier, and their liability cannot be sought in case of faults, failures, or negligence of the carrier.

The products travel at the customer's risk, who bears the full risk of transport.

The products are packaged to comply with current transport standards and to ensure optimal protection during delivery. The customer is requested to comply with these same standards when returning a product.

 

Reception

It is the customer's responsibility to receive and verify the conformity of their order upon receipt and, if necessary, to make any reservations on the delivery note.

These reservations concerning the condition of the products or for any missing items must be confirmed by registered letter with acknowledgment of receipt to the seller within 8 working days following their receipt. It is the customer's responsibility to provide any justification for the reality of the anomalies, apparent defects observed, etc.

 

Beyond this deadline, any delivery that has not been subject to reservations will be deemed to be in accordance with the order and considered accepted by the customer, who will then be deprived of any recourse against the seller.

 

Withdrawal period - private customers

In accordance with the provisions of the Consumer Code, the consumer customer has a withdrawal period of 14 days, from the day after receipt of the products, to exercise their right of withdrawal without having to justify reasons or pay penalties, except for return fees. When the deadline falls on a Saturday, Sunday or a public holiday, it is extended until the next working day.

After this period, the customer will no longer be able to exercise their right of withdrawal.

However, we draw the attention of customers to the fact that the right of withdrawal does not apply to certain products or services, due to their specificities.

 

Exercise of the right of withdrawal

The exercise of the right of withdrawal can be done by the customer, before the expiration of the 14-day period mentioned above, by sending an email to the seller at contact@uman-krapul.com, or by registered letter with acknowledgment of receipt to Mr. Cornet Dylan – 20 TER rue de l’echelle 02420 Aubencheul-aux-bois France, clearly identifying the product(s) subject to the exercise of this right.

Consequences of the right of withdrawal: return of products

Any return of products by the customer will be at their exclusive expense and will be sent to the following address: Mr. Cornet Dylan – 20 TER rue de l’echelle 02420 Aubencheul-aux-bois, France.

Products must be returned in their original packaging and in perfect condition, allowing their resale in new condition. The customer has the right to open the delivered packaging as long as it does not make the product unsuitable for resale. For hygiene reasons, products must be returned unused. Otherwise, a refund cannot be issued, and the right of withdrawal cannot apply.

 

Protection of personal data:
